STATE LAWS CONCERNING
AUTOMOBILE ADVERTISING

EVERY STATE HAS
DIFFERENT LAWS GOVERNING
AUTOMOBILE ADVERTISING.

SOME STATE HAVE TOUGHER
LAWS THEN OTHER STATES.

THE STATES OF NEW YORK
& NEW JERSEY HAVE SOME OF
THE STRICTEST LAWS.

EVERY NEW & USED VEHICLE
ADVERTISED MUST HAVE:

  • The vehicle MUST BE IN STOCK or If it is
    a Vehicle that MUST be Factory Ordered        
    IT MUST BE SO STATED.
  • If a Factory Order, the Customer          
    MUST BE PRICE PROTECTED. IF A LEASE RATE & RESIDUAL
    PROTECTED
    .
    for when the Vehicle arrives.
  • When the Vehicle is IN STOCK IT MUST HAVE THE FOLLOWING:  
  • The Vehicle Identification Number (VIN#) or
    Serial Number
  • Manufacturers Suggested Retail Price
    (M.S.R.P.)
  • Engine Size
  • Type of Transmission (Automatic or Stick
    Shift)
  • If it has Power Steering
  • If it has Power Brakes
  • If it has Air Conditioning
  • The Dealer MUST offer the Advertised
    Vehicle FOR SALE.
  • A Selling Price or Lease Payment
  • IF A LEASE THE FOLLOWING IS
    MANDATORY:
  • Term, Miles Per Year, Down Payment, Total
    of Payments, Total Cost of Lease,  
    Purchase Option, Security Deposit,           
    Bank Fee.
  • If the Consumer must pay any Extra Costs
    IT MUST BE SPECIFIC AS TO WHAT THOSE COSTS ARE.
  • If the Consumer MUST Qualify for any
    Private Rebates it MUST be Explained as
    to what those rebates are.
  • If there is an ENDING Date of the Sale it
    MUST BE Specified.
  • USED VEHICLE Require a Federal Trade Commission (FTC) Sticker Indicating what warranty the Used Vehicle is being sold
    with.
  • If a USED VEHICLE is being Sold “AS-IS”
    it must be 10 years old or older OR have
    100,000 miles otherwise A MINIMUM WARRANTY IS REQUIRED.
  • If a USED VEHICLE the Dealer MUST
    Guarantee State Inspection UNLESS the
    Vehicle is Sold “AS-IS” or The Customer
    Gives Up the Right of Going to State
    Inspection
    .
  • If a USED VEHICLE that goes to State
    Inspection and FAILS for any reason, the
    Dealer MUST Repair any part of the Vehicle
    that failed State Inspection at NO CHARGE
    to the Consumer.
     
THE LEMON LAW ACT is a Federal Statue
Protecting the Consumer which only applies to
Brand New Vehicles
in the first 18 Months or
24,000 Miles.
